The implementation of the juridical death penalty is governed by law no. 2 of 1964; however, its actual application remains contentious. This study aims to explore the societal understanding and philosophical foundations surrounding the execution of the death penalty within the Riau province, Indonesia. Employing an empirical legal research strategy, the research gathered both primary and secondary data, including questionnaires, in-depth interviews, and focus group discussions with community members. The data were then interpreted through hermeneutical methodology framed in a constructivist paradigm, addressing ontological, epistemological, and methodological aspects. Findings reveal diverse societal perspectives on the death penalty, influenced significantly by human rights considerations and the goals of criminal punishment. The study concludes with recommendations for the potential reform of the criminal code concerning the death penalty, aimed at aligning legislation with the philosophical and societal dynamics at play. This contribution hopes to illuminate the ongoing discourse on capital punishment, emphasizing the need for comprehensive legal evolution in response to community understandings.
