In order to conduct a leachate prognosis for contaminated material according to BBodSchV, two steps are necessary: (a) determining the pollutant release and (b) assessing pollutant attenuation during leachate migration through the unsaturated zone. This study explores the controversy surrounding leaching procedures in various research projects focused on source strength, particularly regarding the mobile fraction of contaminants from recycled materials used in road construction. An inquiry involving 20 research projects funded by the German Federal Ministry for Education and Research highlights the need for balancing stakeholder arguments with scientific facts, especially related to forensic processes and regulatory establishments. The findings indicate that the compliance point for the threshold of insignificance should be directly beneath the contaminated material and soil contact zone, emphasizing that only source concentration dictates the material's usability. Different methods, particularly involving batch/column devices, are discussed, demonstrating practical implications for understanding contaminant migration and recommendations for procedural schemes are provided. The study underscores the ongoing debates and the paramount importance of scientific rigor in establishing equitable leachate regulations.
